INFORMATION SESSION
 OVERVIEW

            An information session of Pleasant Valley Board of Aldermen was opened by Mayor David Slater on Monday, June 1, 2009 at 7:20 p.m.
            Aldermen present were: Donnini, Maroon, Smith Jurado, Mast and Bolinger. Ammon absent. Also present were: Mr. Terry Norwood, MARCIT CEO, Matt Gist and Jessica Bernard, representing Ensz and Jester and Tom Capps, City Attorney.
            Mayor Slater called Mr. Norwood forward for introductions and yielded the floor.
            Mr. Norwood gave a brief overview of the MARCIT insurance pool, which the City of Pleasant Valley is a member of and the activities/handling of claims filed.
            The City of Pleasant Valley is slated to realize an increase in deductible from the current ten thousand dollars ($10,000.00) to fifty thousand dollars ($50,000.00) for general liability claims beginning July 1, 2009. This results from the losses incurred during the last three (3) years for a rolling average record. For every dollar ($1.00) paid in premiums there has been a pay out of three dollars ($3.00). The City of pleasant Valley paid a total of $71,003.00 for periods July 2006, July 2007 and July 2008; for that same period MARCIT paid/incurred costs totaling $285,635.00. The City should anticipate a three fold premium increase from 2006 which would reflect a cost of approximately $81,000.00 for liability coverage. 
The bulk of the claims result from the actions of elected officials relating to employment practices. MARCIT has and is providing to member municipalities, assistance in employment issues both from an HR perspective as well as a legal perspective which includes access to attorneys from Ensz and Jester.  To that end, MARCIT is willing to provide a work-session for elected officials that would bring the deductible back down, but the premium will remain at the higher rate. After discussion, a work-session is scheduled for June 29, 2009 at 6:00 p.m.
Mr. Norwood brings Mr. Gist forward and yields the floor. Mr. Gist notes that he has met most of the board before and takes the opportunity to remind board members that they should make their decisions carefully. FMLA (Family Medical Leave Act), ADA (Americans with Disabilities Act) and MO Human Right have each had new/additional laws recently passed. The landscape of employee related law is ever changing and boards need to be mindful of that.
